- Good Faith Statement: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy and Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
B. Legal Consequences of False Claims
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to strict legal liability and damages. 4. Our Takedown Procedure
Upon receiving a fully compliant DMCA notification, Wealth Africa will take the following actions:
- Promptly investigate the exact URL and the material claimed to be infringing.
- Disable access to or forcefully remove the material if the claim is found to be valid and adequately documented.
- Notify the content provider, user, or author who originally submitted the material (if applicable) that the content has been removed due to a copyright claim.
5. Filing a DMCA Counter-Notification
If you believe that your material was removed (or to which access was disabled) by mistake or misidentification, you have the right to file a Counter-Notification. To be effective, your counter-notification must be in writing and provided to our Designated Agent. It must include:
A. Required Information for a Counter-Notice
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the specific URL or location at which the material appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the jurisdiction, the relevant legal jurisdiction associated with our corporate address in South Africa), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Once we receive a valid counter-notification, we will forward it to the party who submitted the original claim. If the original claimant does not file a court order seeking to keep the content down within 10 to 14 business days, Wealth Africa may, at its sole discretion, restore the removed material.
6. Repeat Infringer Policy
In accordance with the DMCA and other applicable intellectual property laws, Wealth Africa has adopted a strict policy of terminating, in appropriate circumstances and at our sole discretion, the access of users, authors, or contributors who are deemed to be repeat infringers. We take our platform’s integrity seriously and will not tolerate chronic violations of intellectual property rights.
